No Guarantees of Outcome: While La Vibe Events, LLC strives to provide high-quality photo mirror services and an exceptional experience, we make no guarantees or warranties, express or implied, regarding specific outcomes, results, or the suitability of our services for any particular purpose beyond what is explicitly stated in our service agreement. The success of any event partially depends on factors beyond our control, including venue conditions, guest participation, and unforeseen circumstances.
Limitation of Liability: To the fullest extent permitted by Florida law, La Vibe Events, LLC, its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; (c) any content obtained from the services; and (d) unauthorized access, use or alteration of your transmissions or content.
This limitation of liability is comprehensive and applies to all damages of any kind, including but not limited to direct, indirect, incidental, punitive, or consequential damages, even if La Vibe Events, LLC has been advised of the possibility of such damages. Third-Party Venues: La Vibe Events, LLC operates as a mobile photo mirror service at third-party venues chosen by our clients. We do not own, operate, or control these venues. Therefore, we are not responsible for the safety, security, accessibility, or any other conditions or incidents that may occur at any third-party venue. Clients are solely responsible for ensuring the suitability and safety of their chosen venue for their event and for our setup requirements. Our liability regarding venue-related incidents is expressly disclaimed.

By booking our services, you agree to abide by these terms.
These terms are governed by the laws of the State of Florida.
1. Booking & Payment

A 50% non-refundable deposit is required to reserve your date. Your booking is not confirmed until this deposit is received.

The remaining balance is due no later than 7 days prior to the event date.

Accepted Payment Methods: Credit Card, Venmo, Zelle, Apple Pay.

Late Payments: Payments not received by the due date may result in the cancellation of services without refund.

Sales Tax: As a business operating in Florida, all services are subject to applicable Florida State Sales Tax and St. Johns County Discretionary Sales Surtax, which will be added to your invoice.
2. Cancellation & Refunds

Cancellations made 14+ days prior to the event: full refund of deposit.

Cancellations made within 6 days: deposit is non-refundable.

Rescheduling is permitted one time, subject to availability and must occur within 14 days of the event date.
3. Setup & Venue Requirements
Client is responsible for ensuring the following:

A flat, dry, and level space with a minimum footprint of 8 ft x 8 ft.
-
Access to a standard, grounded 3-prong electrical outlet within 15 feet of the booth location.
-
Indoor placement is strongly recommended. Outdoor use requires a fully covered, weatherproofed area (e.g., tent, pavilion) with adequate protection from sun, wind, and rain, and is subject to prior approval by La Vibe Events, LLC. In the event of unsuitable outdoor conditions (e.g., severe weather, high winds, lack of adequate cover), La Vibe Events, LLC reserves the right to refuse outdoor setup for safety reasons, and a suitable indoor alternative must be provided by the client, or services may be forfeited without refund.

A venue point of contact must be available during setup. La Vibe Events, LLC will arrive 60 minutes prior to the scheduled start time to begin setup. Any delays caused by the venue or client may result in a reduction of active booth time.
4. Idle Time

If booth setup is required earlier than 1 hour before the start time, idle time is charged at $50/hour.

Idle time ensures the booth remains staffed and secure before operation resumes.
5. Guest Behavior & Damages

The client is fully responsible for the conduct of guests during the event.

Any intentional damage, theft, abuse, or vandalism to La Vibe Events, LLC’s equipment caused by guests will result in full replacement or repair costs billed to the client. This includes, but is not limited to, damage to the booth, props, backdrops, or accessories.

La Vibe Events, LLC reserves the right to pause or terminate booth operation without refund if guest behavior poses safety risks, becomes abusive towards staff or other guests, or threatens the integrity of the equipment or staff.

Children (16 years and under) must be supervised by adults when using the booth.
6. Photo & Media Use

Unless the client opts out below, La Vibe Events, LLC reserves the right to use photos, GIFs, and videos captured at the event for marketing, social media, and promotional use across all our platforms.

Clients may opt out of media use by notifying La Vibe Events, LLC.
7. Technical Issues
-
La Vibe Events, LLC makes every effort to ensure seamless booth performance. In the unlikely event of a technical issue that impacts booth operation, a partial refund will be issued based on the documented time lost from the contracted service period.

No refund will be issued for disruptions caused by factors outside our control, including:

Power outages or fluctuations

Venue access restrictions or last-minute changes
-
Interference by third parties (e.g., other vendors, venue staff)
-
Severe weather (for outdoor events)
-
Guest non-compliance with usage guidelines.

8. Liability Waiver

By booking services, the client agrees to indemnify, defend, and hold harmless La Vibe Events, LLC, its staff, and affiliates from any claims, damages, losses, or injuries arising out of:

Guest interactions with the photo booth and props.
-
Allergic reactions or injuries from props or materials provided (e.g., if props contain latex, etc.).
-
Venue-related incidents or unsafe environments not directly caused by La Vibe Events, LLC.

La Vibe Events, LLC is not liable for indirect, incidental, or consequential damages resulting from service interruptions or technical failures.

In no event shall La Vibe Events, LLC's liability exceed the total amount paid by the client for the services provided under this agreement.
9. Copyright & Ownership

All photo templates, graphic overlays, and digital materials created by La Vibe Events, LLC remain the intellectual property of La Vibe Events, LLC.

Clients may not reuse, modify, or distribute branded booth templates or graphic materials for commercial purposes without explicit written permission from La Vibe Events, LLC. Personal use of event photos/GIFs by the client and guests is permitted.
10. Force Majeure

La Vibe Events, LLC shall not be held liable for failure to perform due to unforeseen circumstances beyond its reasonable control, including but not limited to:

Acts of God (e.g., hurricanes, floods, tornadoes)

Governmental restrictions, regulations, or orders
-
Natural disasters or extreme weather conditions
-
Epidemics, pandemics, or public health emergencies impacting operations
-
Venue closure or failure to provide access
-
Strikes, labor disputes, or civil unrest
-
Other events that render performance impossible or impracticable.

In such events, La Vibe Events, LLC will work with the client to reschedule the event or provide a credit for future services, at the discretion of La Vibe Events, LLC.
Client Agreement & Acknowledgment
The client acknowledges that these terms constitute a binding agreement between La Vibe Events, LLC and the client.
Additional Considerations for Website Display & Florida Compliance:

Business Licensing: Ensure "La Vibe Events, LLC" is properly registered with the Florida Department of State (SunBiz) and has any required local business tax receipts (formerly occupational licenses) from St. Johns County. While not explicitly part of the terms, it's a foundational compliance step.

Sales Tax Collection: Clearly state that sales tax will be added. You must register with the Florida Department of Revenue to collect and remit sales tax. Photo booth rentals in Florida are generally considered a rental of tangible personal property if the client has control over the equipment, or a service if you provide the operator and retain control. The provided terms lean towards a service, as La Vibe provides staffing and setup, but still, sales tax on the entire charge is often applied to such event services in Florida. Consult with a tax professional to ensure proper classification and collection.
